1. ENTIRE AGREEMENT - NO VARIATION WITHOUT PROPER APPROVAL
This is the entire agreement between the parties. There are no collateral representations, warranties or any undertakings of any nature other than that written onto this form. No person may verbally or in writing vary these terms or conditions or assign or transfer the Ad/s to a 3rd party without the approval in writing by Australian Directory Services Pty Ltd, and the order shall be construed strictly without taking into account any unauthorised variation.It is understood that I am permitted to place my business details to this site provided:
(a) All the compulsory fields have been answered correctly to the best of my knowledge and are considered to be correct at the time of entering this information.
(b) That I am not a competitive business to this directory
(c) My business is applicable for use by engaged couples
2. APPROVAL OF ADVERT
All approval of adverts will be viewed by the customer live on the web at a specified location within the Australian Directory Services Pty Ltd site and by not later than 10 business day’s, the client shall confirm the adverts approval or make any changes to the advert. Failure to respond within 10 business day’s shall be deemed as approval of the advert.If instructions are to repeat a previous advertisement, it is the advertiser's responsibility to notify Australian Directory Services Pty Ltd in writing of any changes to the advert. Mistakes approved or deemed approved by the advertiser shall not qualify for compensation.
3. EDITORIAL - ERRORS OR OMMISSIONS & CHANGES
While every effort is made to check the accuracy of adverts / editorial content, prices, business name, addresses, telephone numbers etc, no compensation will be given for positioning of advert / editorial, errors or omissions made in the advert / editorial. Failure to supply advert / editorial material by deadline date shall disentitle the advertiser from any promised advert / editorial space without compensation. Where an order is for advertising space plus a listing or editorial, the charge made is for the advertising space only, with the listing or editorial being complimentary and/or no charge. Any errors in or omissions of such space shall not entitle advertiser to compensation.4. DEFAULT OF PAYMENT
The advertiser agrees to a dishonor and administration charge of $50.00 on each dishonored cheque or payment.5. SPECIAL REQUEST / PLACEMENTS
In regard to special requests or placements, NO GUARANTEE is given that such requests or placements will be complied and such request/s or placements shall not be construed as a condition or term of this order and accordingly, no claim for compensation will be allowed for any non-compliance.6. AUSTRALIAN DIRECTORY SERVICES PTY LTD RIGHTS / LIABILITIES
The advertiser acknowledges that Australian Directory Services Pty Ltd at its discretion shall be entitled without notice or compensation to do any of the following.(a) Destroy any literature, disks, CD or photos given by the Advertiser to Australian Directory Services Pty Ltd that has not been accompanied by Pre-paid envelope for the return of their goods.
(b) Cut or alter any artwork or other materials supplied by the advertiser in order to conform to mechanical requirements (page size).
(c) Australian Directory Services Pty Ltd shall not be liable in any manner for the loss or damage whatsoever to artwork or other materials and such materials shall at all times remain the property risk of the advertiser.
(d) Australian Directory Services Pty Ltd shall not be liable in any way for any copyright infringements of written information or photographs that have been supplied by an advertiser. It is the advertiser’s responsibility to ensure that all information and photographs supplied have been approved for advertising by the copyright owner.
7. CANCELLATION OF PRIORITY ADVERTISMENT / REFUND POLICY
(a) All cancellations of any priority advertising package must be made in writing within 10 business days.
(b) No refunds are given in part or whole; if written cancellation has not been received within 10 business days of becoming a priority advertiser on this site.
(c) All refunds incur a $50.00 administration fee.
(d) Australian Directory Services Pty Ltd, reserves the right to cancel any advertising on their site at their discretion and without any compensation.8. INDEMNITY / TRADE PRACTICES
The advertiser understands that if promoting their business within a competition or auction on the Australian Directory Services Pty Ltd web site, it is the advertiser's responsibility and legal obligation to obtain any necessary permits that may be required. It is also the advertiser's responsibility and legal obligation to ensure that the advertised prize for their competition or auction is available for collection by the winner on the advertised competition expiry date.The advertiser agrees that if attending any Australian Directory Services Pty Ltd expo or events as an exhibitor, it is the exhibitors responsibility and legal obligation to ensure that they have the appropriate liability insurance for their business in order to take part in these expo or events.
The advertiser indemnifies and agrees to hold indemnified Australian Directory Services Pty Ltd, its servants and agents against all liability, claims, actions, demands proceedings, losses, damages, costs including solicitor and client costs and expenses which Australian Directory Services Pty Ltd, its servants and agents, may suffer incur or sustain in connection with or arising in any way out of the publication or error in publication or any material or editorial pursuant to the order and, without limiting the generality of the foregoing, to indemnify and hold indemnified each and all of them against any action for defamation, slander, passing off, breach of copyright, or infringement of any trademark, name of description, invasion of privacy or breach of any provision of the Trade Practices Act, 1974.
